The mother always has custody of her child if she is not married when she gives birth. Regardless of whether the child is born subsequent to a divorce or before a marriage, custody goes to the mother ALWAYS.

In the state of Idaho legal custody is determined by the court. Until then both parents, even those that were not married, have access to the child which can get quite ugly if both parents hate each other. My husband went 5 years without being able to see his kids because he didn't know about the child custody laws until he hired a lawyer to fight for visitation. He ended up getting primary custody and she has to pay child support. The best thing to do would be to contact a lawyer that specializes in child custody.

As a rule the mother WILL HAVE custody. But this is an issue that can be taken to court. For the father to get custody he will most likely have to show that the mother is an UNFIT mother. She is into drugs alcohol ect.... Very difficult to do. And the father (if he doesn't get custody) will most likely end up paying child support.

If the couple is not married, the mother automatically has custody. There is proof that she is the mother in that she was witnessed giving birth. Without an acknowledgement of paternity or a DNA test, there is no proof that the "father" is actually the father.
Even if paternity is established, without a court order stating otherwise, the mother has custody.

Depends on if the parent's live together, what state(s) they live in, who has current custody, how old the child is, and who would provide better care. Try checking with your local family services office or online for specific state guides. A lawyer is also helpful if you are having child custody issues.

I would have to say the mother. Women usually get full custody of the kids because the dad's don't try for it. If there is something wrong with the woman then the man should take her to court, and fight for it. (i.e. drugs, abuse, etc) There is also shared custody.

most likely the mother does.. i think they do a paternity test and sometimes if the father is in a more stable condition than the mother he could get custody of the child.......

BOTH HAS LEGAL CUSTODY.... and it can also be SHARED PHYSICAL CUSTODY ~~ if they are not residing together but want joint custody of the child. NEVER, NEVER, EVER sign papers giving LEGAL custody to a parent ~~ because that will take away all YOUR PARENTAL RIGHTS FOREVER!!!!
