It depends on the resources available and what the crime is. This branch of the government has flaws just like all the other branches.

What detainee? The ones in Gitmo have been there 4 1/2 years and some have never been charged!

If you are talking about those from Mexico, ask their employer!!!

Can be up to 10 years actually what our kids are told if they get caught coming back illegally it will be 10 years in jail and no chance of amnesty ever.

Until they have done the area wide checks to make sure your not wanted. Finger prints photos etc etc. Then it off to an all expense paid trip to beautiful down town Mexico compliments of American tax payers! Gitmo should execute the prisoners!

As this question is in the immigration section, I assume you mean people detained as illegal aliens. I agree with the first answer, send them home immediately.
