i own a construction company and one of my employes wants to be 10-99 i need to find out if i can do this what web site will tell me the rules

Here is a page on the IRS site that gives you the differences between independent contractors (1099 workers) and employees (W-2 workers). http://www.irs.gov/businesses/small/article/0,,id=99921,00.html

Be careful because if you classify someone as an independent contractor and the IRS determines that they are an employee, they will hold you personally liable (regardless of whether business is in corporate/LLC form) for any underwithholding of payroll taxes.

you really need to talk to your tax preparer or the IRS to get the correct information, using the 1099 form your employee is trying to avoid paying federal taxes!
