No credit card company will hold you liable for charges incurred on
your card not by you.

However, you may be in the position of proving that you didn't incur the
charges.

If the guy is caught and successfully prosecuted, his guilt will be sufficient
evidence for the credit card company to believe that you didn't incur the
charges and they will certainly stop going after you.

Note, however, that credit card companies are very aware of identity
theft and scared to death of it - not because of the billions of dollars
lost to them from fraudulent charges, but because they think that it
may cause people to stop using the cards.

They would far rather have you use the cards and pay themselves
for fraudulent charges occasionally then for there to be no fraudulent
charges and no business.

In short - you are not the one that needs to worry about paying for goods
purchased with your credit card not by you - the credit card company is.

HOWEVER - the issue is not that credit cards can be used to buy
things - the issue is that credit cards (and information that may accompany
them such as PINs, addresses, social security numbers, etc) can be used
to acquire rights to things that CAN do you considerable damage.

For instance, people take on debts using other people's property as
collateral, etc.

Don't worry about the credit card money - worry about what else he
got with that ID.

You recover your money the same way you would even if the thief wasn't caught.

You report the matter to your credit card company. They take care of returning your money.

You also report the matter to law enforcement so that they can work on catching the criminal.

Even if you dispute the charges with your cc, if the thief is caught, they will work on recovering those charges from the thief directly.

I think all cards follow the rule that as long as you signed the back of the card and you reported it stolen, then you will get your money back. How long this may take will depend on different banks. Some advertise that it will only take 24 hours others you could wait weeks while the "investigate".

Today most credit card companies have a fraud program in place and when contacted your credit card company has thirty days to replace the money!

It's called restitution. You can, in some states, receive restitution from the inmate. All monies sent to him or her can be forwarded through the state towards you. Not all states have this and you can bet if they do have it.. the state will see it's share of the money first.

u'll never get back the money...the best thing he could hope for is to take all the things the person bought with the money. its his money anyway

It depends on what his bank offers. I use bank of America and they will replace any money stolen from my account. Please tell let your friend know he needs to contact his bank to cancel that card.

call the company and if he used it for something you have never gotten they will see that you did not do this ie you like pizza hut and the other person like Greek food

The judge can grant it at trail or he can sue person who stole it.

file for identity theft or contact the attorney gerals office and consumer fraud. that would help
