Who knows what kind of damage was made. Don't want to be stuck with payments for the next five years knowing the car might not be safe, compromised performance, unforeseen issues, and factory warranty out the window. I believe this will need to be taken to court if my car is not replaced, since “fixing”, or making it “look nice” is not remotely acceptable. Any comments on this one would be greatly appreciated.

Estimated KBB value: $31,000.00 - without accident.

The car is also crunched in on the sides, (chassis problems?) up to the middle of the rear wheels/tires. Basically, it's about half the car. So I guess you guys can see why I am upset now. Only 6k miles... I’m no authorized ford technician, but know a thing or two about cars. Personally, I’m thinking there is at least 15-20k worth of repairs. I’m not terribly concerned about the cosmetic appearance of the vehicle. Any more comments on this one?

Hey, you should get a lawyer for sure, they'll make sure that your insurance company pays you to fix your car so you suffer 0 loss from this incident, without a lawyer you have little chance of coming up with something from them.

If the damages don't exceed about 80% of the fair market value they're not going to total it. No amount of screaming or lawyering is going to help you on that.

If the damages are close to or more than 80%, they'll total it and give you FMV. This will probably not cover the outstanding balance on your loan. No amount of posturing or screaming will get you any more than that, and any lawyer worth a dime will tell you the same thing.

You'll be much better off having it repaired. You might even have some luck pressing the other driver's insurance company for some extra $$$ for "loss of intrinsic value" since it has been wrecked. I snagged an additional $2,500.00 a number of years ago for just this thing and they didn't bat an eye when I asked.

BTW, your warranty will NOT be voided by the repairs as long as they are carried out to the manufacturer's standards. All good body shops do their work that way. Since your vehicle is under warranty, you have a strong position to force them to pay to have the repairs done at a dealer or a higher-end shop that is certified by the auto manufacturer.

Depending on the insurance company you will probably need to have an estimate of damage that is above 80% of what the vehicle is currently worth at that time for a reasonable fight. Furthermore, if you are looking for a replacement. The company will pay out up to what the vehicle is worth at that time. The difference would be carried upon GAP insurance (if you have that). If not you may be out of pocket for the difference.

Well, boo-fu*king-hoo for you. I can tell you are one of these a$$holes that wants to sue anyone for anything. Unless you have in excess of $10,000.00 worth of damage you will look like a silly a$$ trying to convince a judge you deserve a new car. A reputable repair shop can restore the vehicle to near factory specs, usually with a lifetime warranty on repairs. If you are so sickened that you cannot drive a car that has been 'violated', (which is exactly what this is all about as I have to deal with butt-munches like you everyday) then fix the damn thing and sell it.
CAUSE YOU AIN'T GETTING A NEW ONE!

I say GOOOOOOOD LUCK!!!!!!!!!!!! I have a completely modified, paid for twice in upgrades Suburban..had some moron slice lanes and I plowed into him doing 55 mph....His 06 Taurus was obviously toast....and they tried to total out my truck. HA! You'll take one of my kids first..lol, (j/k) All I wanted was my truck fixed and the entire thing repainted since you never realllly can match paint...well auto insurance companies don't like to spend more than they absolutely have to....so I say Good Luck again. I think, since I JUST went thru this, your best course of action would be to have your car taken to a place you trust...then get them to tell the ins co your car's frame is beyond repair. That's about the only way you'll get it replaced. Good luck!

Yes it is very reasonable. it was your new car and you should have it replaced just as you want it. Fight for what you want and don't give up.

yes it is,,i wouldn't want it fixed after it got hit from behind anyway,,i would fight for a replacement car,,because they usually never drive right after they have been hit,,don't let them jerk you around,,fight it,,you will win,,because it wasn't your fault.

You need to find an insurance adjuster who'll "total" it.
