SUPPORT LAWS? I have been a SAHM for 20 months, and lived with this guy for 3 years. He makes over 90,000 a year and tells me he is only going to pay 300 a month in child support if I leave. I think I will be getting more than that!
He is being a jerk bigtime.
He says if I leave I cannot take my son with me, (I would be satying at my dads) because I dont have a job or home, well I could go on social assistance until I get my **** together...but he says I wont get the kid. Who is right, by the way this man works out of town mostly.

First things first, according to the Child Support Guidelines for Alberta, a payor earning $90,000.00 per year would be responsible to pay $791.00 per month.

You CAN leave and take your child with you. You will have a safe home for your child and the courts don't care how you support him as long as you support him.

Have a plan, however, to improve your situation such as schooling, a job, your own place.

Next time he is out of town, change the locks on the door and kick him out. Do not leave your child with him until you have everything worked out through the courts. By Canadian law you are considered married, and you are the primary caregiver. Unless you husband can PROVE you are incompetent, you will retain custody. Try to stay in the house, it will go easier for you to get alimony and child support. A judge will decide how much child support he will pay and visitation or joint custody, not one person in the relationship. Good luck and go see legal aid.
