I've had some problems with my oldest daughter also. They get so smart and want to take there problems out on us. So there are parents rights but you have to prove that the children are in some form of neglect. You might even be able to get the children with you for a while that way she can get her life together. We are all families and we all have problems sometimes we are up and other times down. Be patient that is what god asks of us. Try not to get sick or over stressed these bad times will pass and good times will come again. You can file a petition in court or even better contact CPS they would have more information. Shelters can be good also they do help with resources she might even have more of a chance of getting a apt through a program if she is there at the shelter. I was very close at one time of being in the shelter with my children good thing housing came through for me. It's a lot of work and it takes a emotional toel on a women. We feel like as if we fail our children and it takes time to recover from this it is very hard. Try your best to just be there for her and the kids if she wants it. After all she has only one family. Also it sounds like they do qualify for the shelter dont get them in trouble with the county they can take everything away from them and the only one that will really suffer is your grandson. And our children are not our enemies just sometimes they go off track. Be patient I am sure that it's your love for your daughter and grandson that is breaking your heart inside. Just know there are many families going through the same crisis and that is the word crisis. god bless you and your family give it time and everything will turn out fine.

Different states have different laws governing grandparents rights. In MO where I work for CPS, we DO NOT get involved with grandparents rights, it is a legal issue that is to be dealt with in court. Even then, grandparents rights is pretty much a joke. Your daughter has the right in this state to keep you from seeing your grandchildren. All she has to say is you are a bad influence. We get it all the time...I wanted to let you know because you are getting mixed answers. It would be best to contact your prosecuting atty. who can give you free legal advice and take it from there. Grandparents have no rights unless the parents give them custody, or if you can prove it's in the childs best interest to be with you. It may be considering the situation with the homeless shelter, which is considered an unstable environment. Talk to a lawyer if you decide to persue this, but the state may also get involved.

I think your daughter may have some very real problems that endanger your grandkids. If it were me, and there are no lies going on here, I think I would petition family court for care of kids until your daughter gets her life straightened up...she could well be on drugs. Or, being honest, you may be impossible to live with...only she and you know for sure.

after youve tried talking to her, than pursue the ugly route of getting grandparents rights, you may need to talk to social services to advise them that the children are being put in an unessasary situation. you need to talk to some type of free legal aid in your community, they are available, look in the phonebook. my mom went thru the same thing with my sister, sometimes people just act stupid.

Yes, you do have rights to your grandchildren. Contact DHS and they can tell you the correct channel to go through.

You have to contact an attorney and sue her for the rights as you can get grandparents visitation.
