Why would anyone fly the two together? It is disrespectful to both flags.

Hell son..it's the US..you can do anything you want.
I'd wager if you were in the right neck of the woods and you flew a confederate flag above, or higher, on a seperate but nearby pole, you wouldn't hear a peep.
In another neck of the woods you wouldn't even get that flag out of the package it came in before you'd have people, goups and organizations up your a$$ with a crowbar.

In either neck of the woods it's technically against flag etiquette and you might even be breaking a law or two..or ten.

In about 20 years of traveling all over for a large corporation..I have seen no less than 20 or so "flag gaffs". When someone, quite by accident, flew the flag improperly, too high, to low..at half mast when it shouldn't have been..etc., etc. The worst I ever saw come of it was a phone call or a visit from the local law just saying.."Hey...you might wanna redress your flag there..it's not supposes to be flown at half mast"..or whatever else it might have been.
If you are perceived as flying or displaying a flag in an INTENTIONALLY disrespectful manner however..I'd wager you'd find out about ALL the laws governing such.

No flag can fly higher than the US flag, on US soil. My company has 3 flagpoles. One has the US flag, one the state flag one the company flag. All poles were the same height and all flags flew at the top. We got in trouble and had to run the state and company flag down the pole a few feet. Looks stupid.
On another note, if I ever saw a rebel flag flying above the US flag, there would be some hate and discontent handed out.

No other flag is to be flown about the US flag.

and of course which confederate flag ( most people would not even reconsise the actual flag of the confederate states, they only know the confederate battle flag which was a military flag, not a national flag of the confederate states.

The United States Code Title 4 Chapter 1 has guidelines for appropriate display of the flag, but it doesn't appear to include any penalties for violating its provisions. There may be additional laws governing this activity in your locality.

Having said that, flying a confederate flag over the US flag (or at all, in many parts of the country) is extremely insulting to a great many people in this country, and may incite extrajudicial reprisals against the property and person of whoever is doing so.

According to "Flag Law". No flag can fly above or to the right of a United States flag (Unless you are at the United Nations building).

No flag may be flown higher than the US flag. The Flag Code stipulates this in Title 4 of the US Code.

The flags of friendly foreign nations are flown at the same height as the US flag.

All other flags (state, POW, company, confederate, etc.) must be flown LOWER than the US and other national flags. They may be flown on the same staff(s) as long as they are on the bottom.

(This trumps TX law to the contrary, BTW.)

No. In fact all US state flags except the Texas state flag must be flown lower than the US flag. The Texas flag can be flown at the same height.

Not suppose to be. The US flag when flown with other flags should be at a position that is higher than the other flags.
