1 - make sure all the adults involved agree. Fighting over a child is emotionally damaging to the child and does not seem to be warrented in this case.
2 - ask the boy what he thinks. I am guessing you are still with Mum so you wouldn't be taking him from her. Be sure to make it clear you aren't going to stop him from seeing his Dad because if they are seeing each other weekly, that is an important relationship for both of them. Give plenty of time and patience for this conversation as the boy will have lots of questions even if he is afraid to ask them. He could jump to the conclusion his Dad does not want him anymore or that you are trying to get rid of Dad. Most of all, be honest with him because if you lie about anything you could permanently damage his trust leading to a ton of other problems.
3 - if everyone agrees it would be a good thing, contact a lawyer.

Get a family lawyer to guide you through the steps. But before you hire one make sure his father will sign over his rights to you. If not you will be wasting you money. Also, check with the boy to make sure he understands and approves of it. He could oppose and the judge rules against you. Good Luck

Contact a lawyer. Also once you adopt him, his father will no longer have to pay any child support.

C.A.B...... they will put you in touch with the right people, they can even make an appointment with them for u to get the ball rolling. but make sure u have permission first... they will ask u this before anything else, if no contact is made with child for 5 years, then u can do it without permission.
