Does anyone know someone who was or will be deported because of this law that was passed by Clinton. In it it says that anyone who has be convicted of a felony shall be deported w/o trial if you are not a citizen. My father was wrongly accused and deported after being here for 20 years. I really need to know if there is a way to get him back.

He had a trial for the felony charge. THen the INS took him into custody and deported him.

The felony he was charged with was Maiming by Mob in VA. in English pretty much means that he got a mob together to try to kill someone.

The Immigration and NATIONALITY Act is not a "law passed by Clinton." The INA has been in existence since 1952; it was only updated in 1996.

If your father was convicted, then he was tried. There is nothing in the INA about deporting people who are only accused.

According to section 212a9ai of the INA, If your father was deported because he was convicted of an aggravated felony, he is not admissible for twenty years.

If he was convicted of a felony, he must have had a trial. Since the due process for a criminal trial is MUCH more favorable to the deportee than an administrative deportation hearing, I don't see what a trial would do differently.

You can check with the immigration service, but I don't think you will get anywhere with it, to be honest.

If you can prove he was wrongly accused and convicted then there is a chance with an Immigration judge. The key word here is PROOF. Without that, sorry but there is zero chance for him to be allowed back.

i don't no the answer sorry but that is so bad the more questions i read about America the more i hate it .after 20 years he should of been a American passport

If he actually went to Court and was found guilty, I don't think you have a hope. Sorry.
