A street cleaner reversed into my car and then got out and tried to say I hit them!! How can I win this? I have contacted insurance companies, home owners associations (it was right in front of my house), the street cleaners employer...everyone says since the stories are different and there is no witness or police report they can't do anything. The police came but there isn't a report.. HELP PLEASE!!

Fortunately for you, he was backing up! 90% of the time if they were backing up, it's thier fault. I'm not sure why the police didn't file a report. You need to hire a lawyer dear. There is just no way around it. Don't worry about paying attorney fees. Most lawyers won't charge until you get a settlement and if you don't get anything, they usually don't charge anything. Make sure you get that in writing from your lawyer though. Fight this! You can definetly win. Sue, SUe, SUE! I would! You need to find out what police officer came out to your house. Make sure you tell your lawyer everything and take pictures. Don't worry, things will get better if you keep on your lawyer. Oh yea, and if the insurance company calls, don't answer any questions. Let you lawyer handle it. Simply tell them to contact you lawyer. Good Luck!

Ask the police for an accident report or a " blue form", an accident report you fill out yourself. The police may not do an acciddent report because of several factors, but you can do one your self.

If there are no witnesses, it is hard to prove who went what direction. You will have the same marks no matter which way you were going.
