i accidently touched a cops arm (no fighting) at my home it caught fire and i was staggering outside from smoke and accidentely bumped his arm then he damn near beat my leg off with a metal night stick and took me to jail then the damn da tried to charge me with a damn feleony for christs sake ,now my leg hurts all the time and im left wondering wtf? was that all about?

your acting just like i thought ive told you exactly what happened but for some gd reason like most people that its not happened to "oh that cant be right a cop is good there must be more to it " are you people that damn brainwashed?

If you are not under arrest or being detained by an officer, they can no more touch you than you can touch them.

An officer at the scene of a fire should be there for crowd or traffic control only, unless there's reason to believe that a crime is being committed at the time.

If everything that you've stated is true, then this is what I'd do in your position:

Get an attourney, criminal and civil. File a formal complaint with your city and its police department for police brutality and demand that the officer be criminally charged with assault. As a person escaping a burning building, you can be expected to be in a state of panic due to your situation and under an altered level of consciousness due to hypoxia from smoke inhalation. Accidentally bumping an officer or even actively grabbing at the officer for support would be perfectly normal in that circumstance.

The next visit should be to the DA's office. Let him/her know that unless all charges are dropped and the arrest expunged, you'll be notifying every news agency from your local paper to MSNBC about how fire victims are treated by authorities in your city and how the DA's office wrongfully prosecutes and covers up for criminal police misconduct.

Your civil attourney should then hit the city with a nice lawsuit for your medical damages, pain and suffering, emotional trauma, etc.

Again, this advice only takes into consideration that everything you've stated is true and that you haven't omitted anything pertinent. If the house fire was because your meth lab went kablooey, and you 'bumped' the officer as he was arresting your baby's-momma for child endangerment, well then, those things might affect the outcome of your lawsuits, eh?

Cause a cop can say anything. You never know what will happen if you don't file a claim.

No, really they can't say what ever they want but there are so many things that we would do or say to an average person that you can't to a cop. Something that simple is Battery. Assualt is saying that you are going to do something. The actually touching is battery.

There is nothing that they are going to do about the pain because simply put: the cop was defending himself.

File a claim, see what happens. Good luck.

But to answer your question...
First, where was the fire department at this time?
Second, you didn't just "touch" the cop....you lit him on fire.
Third, apparently you weren't THAT on fire, as you survived the beating, the jail, and are here posting.
Fourth...it's a well-known fact to anyone who's worked with the general public...even public schools...that "just touching" a person can be an initial act of aggression, and so it's best to nip aggression in the bud by disallowing it. THEREFORE, it is especially wrong to "touch" cops who deal with some of the worst of the general public every day.

Granted, you were on fire....for some reason...though you survived it....somehow....and apparently there were no witnesses ...like firemen....for some reason...even though your house was on fire...

So beats me why you were beaten.

Dude, try being black (assuming you aren't). You always fit the description or something mundane and they ALWAYS search your vehicle if you drive sometihng other than a hooptie. Try when they kick down your door looking for someone that lived there before you rented that residence. All you get is sorry, you can sue if you want... but you will lose.

You described a very uncommon scenerio. I was a Sheriff for 9 years. What you claim is rather....lax.

Be that as it may. NO. You would be wise not to touch a cop in any way or form. You believe what you want you too.

I would only suggest out of advise, you be careful, he might hand you your teeth in a plastic bag.

had you done something before that. Had you done more then just bump into him. You had to of obviously because that is illegal. And most police do not have night sticks they have been replaced with mace ad guns.

dats wrong!!! some cops think they can do anything dey want now! i just heard two stories yesterday on the news for cops beatin on some people. & i heard it a couple weeks ago.
They probly think they all big now.
