There isn't any INS any more.

It is far easier and less nerve-wracking to petition for your fiance or spouse, have him or her get an immigrant visa at their nearest US embassy or consulate, and just do it the right way rather than going through the painful and often screwed-up process of trying to adjust status after the fact. US consular officers like myself issue immigrant visas every day to people just like your intended, and off they go to the US.

I am a US citizen who married a Namibia citizen - we went through the fiancee visa (k-1) process - the interview in his country was not bad, but I don't know what it was like in China. We had to provide supporting evidence of how we met (I had been in the Peace Corps in Namibia so that was fairly easy). Getting here was easy (it took less than a year from start to dfinish) but he has been here for 2 1/2 years and we still don't have a permanent resident card and immigration has been giving us quite the run around. If you don't hire a lawyer, make sure that you complete the paperwork correctly - the uscis website has pretty much everything you need. Just know that although the process goes quickly for some, it is lengthy and frustrating in other situations (like ours).

I don't know about China but I can tell you my experience.

I married a Mexican citizen. He came here with a tourist visa and we got married. Then he applied for a green card and received that. Now he currently has his residency, which takes about 3 years from the time he came here and we got married.

I don't think there will be an interview in China, but there will certainly be one here with your local INS office.

Have you gone to INS web page to find out the details? We downloaded all the documents from there and didn't hire an attorney but did it ourselves. The total cost was around $3,000.

Please, before you do anything and spend any money, do your due diligence and go to your local INS office and get the real information....Good luck!
