I am legally separated and have been travelling to put distance between my ex and myself to give him time to come to terms with our split. I recently decided to come home to my family and contacted him to test the water. He has emailed me telling me to stay away for our sakes and the sake of whoever I decide to start a new relationship with - he said if I do come back it will not be pleasant for all concerned.

With reference to the answers given below, why should I be forced to move away from the place I grew up in and where all my family and friends are because of someone else's threat of ILLEGAL action!!! CRAZY!

they have to have the means and "intent" to carry out what they have said. If someone says "im gonna kill you", that's not really considered a threat unless they are known to have weapons, etc.... The police have a hard time determining it, so if you have a restraining order, they can enforce that MUCH MUCH more than a verbal threat... (you can get a no contact restraining order)...

Every state has different laws.. You can go online to your state's website to see if they have them posted. It'll be under a title of State Laws, or something like that........ The actual words of "It will not be pleasant for all concerned" does not actually show a threat of severe bodily harm, injury or death. That's what is needed to go forward with a threatening charge. If you can show the Police how fearful you are of that person, to include different forms of evidence (letters, notes, messages, emails) etc, then that may be enough. If anything, at least a Restraining Order would help keep distance for you cuz if it's violated, they get arrested. It's that simple. Start a log (notebook) of everything you get, either voice threats, hang ups at your home, cell or work, or threatening notes, etc..... hope it helps........

You have every right to travel anywhere you wish without hindrance in this country. If you construe his e mails as a threat of physical violence you should contact the police in your home area and maybe also see a solicitor about getting a restraining order put on your ex. Having said that the police can be notoriously reluctant to get involved in what they see as domestics, and sufficiently bitter and disturbed people will ignore restraining orders anyway. You know your ex, you should assess the level of threat for yourself, but if he has a history of violence then it would be significant. You do have the right to see and live with your own family, but I would urge caution.

I have just read some of James M's other questions and it confirms it he his about 4 years old with half a brain if it was in a sparrow it would crash.
Get a restraining order love, the Police can't do anything until you have been assaulted or threatening behavior was used with a weapon.

That could be considered a terrorist threat.
If you do move back you might want to consider getting a restraining order issued against him. Not that will guarantee to keep him at bay. If he's intent on doing you or another person harm he'll try it anyway.
If you don't have to go back permanently, why invite trouble.

my suggestion is to stay away because the damn police won't do anything until you are in the hospital or dead. I don't like the way they work but it is the truth. You shouldn't have to move away.

Sadly, the police can't do anything until he's already hurt you, or atleast attempted to hurt you. That is just they way our law enforcement is screwed up right now.

any behaviour that you feel may threaten your personal & physical safety but its a very grey area try to bring someone with you next time you visit
