The person who kicked it or the movie theatre/concert hall?

(It hasn't happened to me yet surprisingly, but just in case I do drive someone to do that to me someday, I want to be prepared!)

I believe that you could sue both the concert hall and the guy who kicked the chair.

Someone's got to be doing some SERIOUS kicking.

In either case, maybe you could just find out WHY he was kicking your chair.. maybe he was pissed off because you brought your scrumptious McDonalds meal to the show with you, all he can smell is your food and quite frankly, he's hungry.

Oh wait.. you said it hasn't happened to you. Either way.. sue the kicker. And then tell him they have sports that would benefit from his odd habit.

You could try and sue both but i think it would make more sense to sue the guy kicking because he's the one that caused the body injury but if you want more money you could try and get the theatre involved...

First, report the kicking to the manager. If suing is necessary, sue the thatre, uless you know who the kicker was- in which case it would be the kicker.

I think people are too sue happy nowadays, and sue for the dumbest things (the lady who sued McDonalds because she stupidly put hot coffee between her legs, hit a bump and it spilled on her)

I would sue the entire row behind me since the seats are all connected at the arm rest..guilty by association

The person that caused the injury is the one that is responsible however, don't expect much in damages. Most small courts only reimburse you for the medical bill and almost never in punitive damages or lost wages.
