Is it hard to prove domestic abuse and get a conviction if the incident occured months in the past and the police were never called?

Yes, I believe that it would be hard to prove. Without photos and statements from the parties invovled soon after the incident, it may be almost impossible. You can always try, what is the worst that can happen? Also, if the abuser is still around, odd are that they will abuse again. Make sure the victim calls the police as soon as possible!

well it depends. Certainly the police should have been called when the incident occured. Is there anyone that know about it? Saw the bruises or whatever? If so, it could be defended that the abused was too afraid at that time to call, but did tell (or show)_______.

if you have no whitnesses, and also didnt keep evidence of the abuse, (photo's or written testimonies from neighbors) then yes. It can be extremely hard.

You should always document any abusive situation, even when the police are called, which should be EVERY time there is a domestic dispute that results in physical violence.

Past issues unreported are tough. Have the person start keeping a journal of every little thing that happens, talk to neighbors and let them know what is going on so they can help, take pictures.

Most of all, get away and never look back.

The above is a great technique for problems with people at work or in a divorce. Write it ALL down - dates, times, names, phone numbers, quotes. Facts and details are what people want to see, not, well, he wasn't nice to me.

Yes, almost impossible. Especially if you have no witnesses or pictures of bruises.
I called the same night my ex beat me and when we went to court he lied and said he never touched me luckily the cop testified about the bruises and marks on my face chest and neck, and told the judge that the only way they could have gotten there was if i was attacked by someone. He got a 6 month suspended sentence and 2 yrs probation and a 500.00 fine.

It would be a case of he said she said, without a witness or police report your claims to physical abuse would be mute. If a person saw you the next day with a black eye or busted lip, they could be considered a corroborating witness. You can claim mental abuse though, he yelled at you, cursed and berated you. That is very easily argued...

But u can get a , order against the person and if the person brake the restriction u can call the polices and then he or she will get arrested but without prove is going to be she said he said and u dnt want that. but if the happens next time take picture allot of picture,,,,

It depends. I've known people who have a mile long list of proof and there was no conviction and I've known others who had no proof and the accused was sentenced anyway. There does not appear to be any rhyme or reason to how justice is served in this country.

Is there a witness to said abuse? Neighbors?
Without tangible evidence or a witness theres not much of a case I'm afraid

Yes it is - unless there is documentation of the abuse people can make things up for revenge. Police have to have reports, pictures, doctor exams, etc.
