My ex-husband was pulled over for speeding in California on his way home to Nevada; he had a valid NV drivers license, he was driving my car (Calif. registration) he got a ticket for speeding and for not having a valid CA license. He tried to explain to the officer that he didn't live in CA, cop said it didn't matter, to drive a car registered in CA you must have a CA license. I went to pay ticket for him was told the same thing by 4 people at the court. Is this true? What about people on vacation from different states that rent cars in California? This makes no sense

Wow, I appreciate that you guys are like sympathetic that my ex might be out to screw me(Metaphorically speaking) I only mentioned he was my ex because the question wouldn't make sense if I said that he's my husband but lives in Nevada, when I live in California. We're fine as an ex couple, get along much much better than we did while we were married, so the marriage part doesn't play so much into the question. But thanks for being cool about that!

You CAN drive in CA with a valid out of state drivers license! Taken from the DMV web site:

"If you are a visitor in California over 18 and have a valid driver license from your home state or country, you may drive in this state without getting a California driver license as long as your home state license remains valid.

If you take a job here or become a resident, you must get a California driver license within 10 days. Residency is established by voting in a California election, paying resident tuition, filing for a homeowner's property tax exemption, or any other privilege or benefit not ordinarily extended to nonresidents. "

That can't be right - what about rental cars? If I fly to California and rent a car, it might well have CA plates, but since I don't have a CA address, I couldn't get a CA drivers license if I wanted to!

There's got to be something more to this law. Possibly because it was your car and he's an ex-spouse - is he completely ex, or is a divorce still pending? I suppose there could be some technicality there that could get you. Or is his name still on the title? That could explain it.

Well, he's not telling you something, but at least he got out of paying for the speeding ticket!!

You CAN drive in CA with a VALID license from any of the 50 states. Is his Nevada license expired, or suspended??

Possibly his License has a suspension or hold? You are able to drive in CA without a CA DL. Even when you move here you still are allowed up to 30 days

The cop is an as$hole. You can't get a ticket because you're driving in California without a stupid California license...unless you're staying in california for, i think, over a month. I believe that was said in the drivering instruction booklet...that cop is f*cking stupid!

You can drive in CA with any state license and plates without any fear of a cop pulling you over unless you are breaking the law. Take it from me, I see cars here from every state living for years using the out of state plates and no one says or does anything. These scufflaws don't pay CA insurance companies, or get smogged or have a valid CA drivers license or pay annual registration fees like the rest of us. Instead, the huge shortfall in revenues at the state level has to be made up with higher taxes on CA residents! Idiotic.

You can drive a car with an outside of california liscence when you pick up your rent a car at the airport because they support it with the insurance they provide for you . but in most cases thats right....

reverse loophole.... here in Ohio the law is the same Oh reg car you must have Oh lis. BUT it is never enforced... Imagine the trouble rentals would have of all states had and enforced such STUPID laws..
