this is a dining question as it has to do with finding a gross item in the food the hard way (in the mouth), a cover-up and the restaurant changing hands twice since then.

It depends on the type of lawsuit it is. The limit may vary depending on whether it is a federal or state case, and may vary from state to state [for the same type of case].

Call a lawyer & ask (over the phone) if the case can be filed. Most lawyers give first (short) consultations free. OR, perhaps you can call you local State Attorney's Office for the free advice.

Since this is the food/drink department, I say pour yourself a drink a forget about the lawsuit!!
