If Child protection service wants to take a newborn away from Mom, what are her rights? Texas?

She has the right to get some legal help from an attorney. She can get help even if she doesn't have money. There are lawyers who do "pro bono" (free) work for poor people.You can find them at places like Legal Aid, etc. There must be good reasons why your mother is considered "unfit". She needs to prove these reasons no longer apply. Good luck!

It all depends on the situation but i know a lot about this kind of thing seeing that someone close to me is currently working there!!But if there is preet good proof that she's an "un-fit mother there's not much of a chance for her.

None. I am in Canada. They drug tested me at the hospital just after giving birth. I was informed that should it come back positive, I was not allowed to leave with my baby. They said it was the hospitals baby, not mine (despite the fact that I was the one with the stitches). Of course it was negative, I'm not an idiot or a junkie. A$$holes. Next time I have my kid at home!

That all depends on why she is seen as incompetent in the first place, and usually CPS has a good reason that no one will argue.

She can only hire a lawyer.
