She and you would have to go before the family court system in Texas probably! Your nephews mother can go to the family court system in Texas and ask how best to get this started! Some court systems have Attorneys available paid thru the State! You may have to go thru the Social Service system there - I would hope not - that maybe too intrusive! Try the court system. She would need to go down and ask or the both of you! Have everything stated out - if this is temporary - conditions that she can get her child returned! Both of you need to think this through very carefully - even done legally - it could turn out very badly for all that are involved. If she is experiencing temporary difficulties - she shouldn't relinquish custody of her child! If you all as a family unit can assist her - it would be much better - because individuals change their minds - when the pressure is decreased with just a little assistance! Neither of you would want the pain this may cause your nephew later! Please be careful, cautious, and empathetic with all that's involved in this process!

it all depends on how your state works on cases like this you might be able to hire a lawyer where your at in not have to go to texas in just have your lawyer take it to court in if the mother is willing to sign papers it should be easy
