You need to find out what the statute of limitations (SOL) is for your state.

Also, alot depends on the type of debt. For instance this is a credit card, then your SOL would start running the first time you became 30 days late and never brought the account current leading to the charge off.

If you are past the statute of limitations, they can continue to try to collect, but the cannot sue you. Also, if you are past SOL, you are not legally bound to pay them.

If you became 30 days late and never brought it current more than 7 years ago, they cannot place it on your credit reports.

First step is to check to see if it is still on your credit report. Normally items only stay on for seven years. However, its 7 years from the last time they reported on the item. If its not still on there don't even worry. If it is on there, follow the procedures to dispute it. There is a chance that it may be so old it will come off automatically or that the creditor doesnt respond back in time. I recommend actually disputing everything thats negative because you never know...maybe it gets wiped away. Good Luck!

They will still try after it has fallen off of your credit report. Don't talk to them or give them any information. If they are shady, they will open it back up for another 7 years.
