In NY state, you can legally be in the back seat of a car doing all kinds of nasty things with a 17 year old, but if there is an open can of beer when the cop shines his light on you, you are really screwed.

I don't know what state you are in, but in California, where I am, the law is, no open container. Regardless if you are 21 or over. Bringing home from the store is fine, just don't open it!
