My sister was killed in a car accident on 4th July weekend. I am trying to figure out the results of the investigation. It happened in Alabama (Wetumpka) AKA Small town USA...I'd like to know the toxicology results of the driver that killed her who did survive. I am afraid that the results will be jaded by small town politics and who knows who in the town. All ideas are welcome. What can I research online.

Well first off,,,in a case of a traffic accident involving a fatality the accident report will not be on file for public records until the case is closed....so until the officers have closed the case and turned the report into the state its not a public record.....family can not get a copy of the record until the officer is done with it.

everything is public record, request to see it , if they don't show you, get an attorney (a good one). ususally toxicology records can take up to 4-6 weeks to get back if it included a blood draw, which is a reason in court proceedings are so far apart. Call the jail and get an arrest record or see if the person was arrested and charged with anything. if the person who killed your sister was drunk, he would have been arrested. Drunk or not, their might be a case for neglegence or any other infraction that occurred. fight it, don't let this person go free.

was a tox screen even done? if one was done, it would be sent off to a independent lab to be tested ( they don't run them in a small town)

Next was it city police who did the investigation ? Who is going to prosecute the case ? Have you talked to them.

Have you all thought about filing a civil suit for her family against the other driver. In that your attorney can get records of all the evidence also.

if they wont give it and a public record request doesnt work, then try involving a locak newspaper. they would probably be abele to help to write a story, and theyre more familiar with open records requests and may even have a connection at the police station
