I don't understand the website for immigration and i'm not sure how things work. My dad was born in America but has lived with my mom in france for almost 20 years. My mom, my sis, and me were born in france, and my dad has been traveling from france to america often because he has a business here. He wants to move here to keep better track of his business, but am I able to come to america. I tried to find out but the website is confusing?

If you were born before November 13, 1986, and your father is a US citizen who lived in the US for at least ten years of his life, five of those after the age of 14 but before you were born, then he can transmit US citizenship to you, and you can get a US passport. If you were born after November 13, 1986, he must have lived in the US for five years, two of them after the age of 14 but before you were born.

It is important to realize that, even though as FS-240 will not be issued if you are over 18 years of age, you can still get citizenship through exactly this same process. It's just that, instead of the FS-240, you will receive a US passport.

If you don't have US citizenship yet, you have a couple options:

if you are under 18, then you can apply for US citizenship on the basis of your father's citizenship (IF he has lived in the US for any period of time, if he has never lived in the US then you cannot apply for US citizenship). If you want to get a US passport it is important to do so BEFORE turning 18.

Without a US passport (citizenship) you could apply for residency if your father lives in the US. It would involve an application, but because US immigration laws are quite favorable to keeping families together, it would be nearly certain.

Call your nearest US embassy or consulate and they can start the application process.

Illegal only if you come into this country illegally.

If married to your mother, you should have been registered with the embassy and are indeed a citizen and it isn't a problem at all.

But if not, because your father is a citizen, you can apply to enter because of that but he will have to also sign the paperwork and go thru the process with you to prove that claim of being your parent.

Either find a good immigration lawyer or a good immigration book (cheaper option but very informative). The website is not bad, just take your time to read it.

you are not american citizen your french but you might have certain advantages. and my situation is the exact opposite my dad was born in france but become a citizen here does that mean i can claim french citizenship?

If one of your parents was a US citizen at the time of your birth, than you are a US citizen too.
