In California what is the penalty for Sale of a controlled substance?

To be more exact: What are the penalties for Possession for sale of a controlled substance 11379a and for Sale of a controlled substance 11366? The person was found guilty by the court, not a jury, after a no contest plea. This is in California. (Info from other states is OK, they may be similar.)

Well whether found guilty by court or jury, same verdict stands. Really hard to answer, because it depends on the amount of controlled substance. And other extenuating circumstances like, was it withing 1000 feet of a school building, previous records and convictions, etc. Most normal cases are 5 years for a nominal amount of controlled substance.

A nolo contendre means you don't plead guilty or innocent but are resting on letting the facts speak for themselves. It still is treated as a guilty confession though. They usually give you a lighter sentence with the nolo contendre plea.

Different state laws are just that different. Get a good attorney and hope for the best. Bottom line, find a different way to make money that is honest and legal. This way, you don't always have to look over your shoulder.

( max penalty 24 months) 6 months drivers license susp. 260 hrs comm. srvc and 2800.00 fine . 5 yrs sounded pretty good after all....Being on paper sucks and I can say I love my freedom and learned a good lesson as well as an expensive lesson.
