If someone has overstayed their visa to the UK, but wants to fix the situation and get married to someone in the UK, what can they do? Are they totally out of luck because they didn't do it correctly in the first place? It wouldn't be a marriage of convenience because they have known each other for years.

Where do you intend on getting married? If you plan on getting married in the UK you will need a "Certificate of Approval". As you don't have any leave you will not be able to get one.

Your best bet is to go back to your country of citizenship, apply for a fiance visa, return to the UK, get married then apply for a spouse visa.

You won't be able to change your visa from within the UK - a trip back to your home country is unavoidable.

It is often easier to get a residence permit in other EU countries. Your brother needs to get out of the UK asap. If he is caught as an illegal he will jeopardise his chances of getting back here. If he returns to africa and gets married there, there is no guarantee that he would be able to come here afterwards. As a spouse he should be able to get a residence permit for his partners country of origin, ie Spain, but even that can take time. At the minute An african born wife of a British Citizen will take up to 3 years to get permission to enter this country legally. Once he has that then after 5 years he can apply for citizenship. Once he has EU citizenship he can live anywhere in the EU.

They are coming down hard on these fake marriages now so I doubt very much that you could now convince ANYONE that this is real. The immegration officers are not stupid. You WILL be deported even if you get married.
