I read about this once and the law states that it is justifiable homicide to shoot those who would commit criminal mischief at night.
If you shoot someone, the police will do an investigation to make sure that it wasn't a crime. They will ask you what the person was doing at the time that you shot him/her. "He was in my tool shed" will most likely get you off. "He had just rung the bell on my front porch" will be harder for you to prove, and you may end up getting charged.
Texas is the exception of the 50 states of the Union. The defense of justifiable homicide has usually meant the slaying of another who is in the process or about to commit a felony against a person who is in imminent danger. In this case, someone crawling into your home through a window could be shot in all 50 states, but someone running away down your street with a TV could not.
Usually, a visibly displayed southern cross is enough to warn others of the capabilities of the household, but a warning shot can give the message without spilling blood on your lawn.

Texas is one of the few states where the time of day does not matter. In Texas if someone is on your property and actually stealing property and even walking out the door with his back to you the law says you have the right to shoot him in the back and kill him in order to regain your property. It actually extends to people stealing rims off your car in your driveway as well and has prompted many legislators to change the law but nothing has yet been done.

I'm from Houston and yes you can shoot anyone who traspasses on your property. Even if its the light man coming to shut off your lights. But only shoot at someone if it really comes down to it. The Houston Police is crap but I would call my local police first. If they incite violence towards you, family member, neighbor, friend, or pet. And were not allowed on your property then you have a right to shoot away.

Most states require that the person be inside your home if you shoot them. You have to prove fear for your life. If the person is in your yard, chances are you will be charged, but if they are inside and you can prove fear , lock and load, fire away. Good luck.

I believe times have changed, you must fear your life is in danger.
For instance if you shout "I have a gun!" and they rush at you anyway..
If you shoot into the floor, and they still rush at you...
Check with a neighboorhood policeman to be positive.

If they are on your property, you have to warn them first. Then - ker-blammo!!!
It would probably be frowned upon if you shot them in the back though as they were running away.
