My ex husband wants to "give up his rights" (to get out of paying childsupport) to my daughter. He says that it is up to my 2nd husband and I to "get the ball rolling" and start the adoption process. We are perfectly happy with HIS decision to do this, but something seems fishy about it. You would think that if the mother does not contest it, then a father should have the right to give up their rights w/o having to first get a "new father" to adopt her.
ANY info that anyone can give would be appreciated...Because of work hours, it is hard to get to a lawyer and we just wanted to see if anyone else here new some answers. Thanks!

I am not sure about MO, but in Wisconsin, they won;t allow a father to terminate his rights w/o a NEW father to legally adopt...because...if you ever needed assistance (foodstamps, medical, etc) then the state would have no father to collect child support from. For your husband to adopt you would need to contact a lawyer. But it should a fairly easy process.

You can get his rights terminated WITHOUT your new husband adopting your daughter but that means no more support, nothing from the ex.
