all depends where you live because While the phrase age of consent typically does not appear in legal statutes [1], when used with reference to criminal law the age of consent is the minimum age at which a person is considered to be capable of legally giving informed consent to any contract or behaviour regulated by law with another person. This article refers specifically to those laws regulating sexual acts. This should not be confused with the age of majority or age of criminal responsibility or the marriageable age.

The age of consent varies widely from jurisdiction to jurisdiction [1](pp.40-59). The median seems to range from fourteen to sixteen years, but laws stating ages as young as twelve and as old as twenty-one do exist. Some jurisdictions forbid sexual activity outside of legal marriage completely. The relevant age may also vary by the type of sexual act, the gender of the actors or other restrictions such as abuse of authority. Some jurisdictions may also make allowances for minors engaged in sexual acts with each other rather than a hard and fast single age. Charges resulting from a breach of these laws may range from a relatively low level misdemeanour such as "corruption of a minor" to "statutory rape" (which is considered equivalent to rape, both in severity and sentencing).

There are many grey areas in this field of law, some regarding unspecific and untried legislation, others brought about by debates regarding changing societal attitudes and others due to conflicts between federal and state laws. These factors all make age of consent an often confusing subject and a topic of highly charged debates [1].

Well, I had sex earlier than that, but anything is legal as long as you don't get caught....lol. Seriously, statutory rape laws vary from state to state. I think for most of the U.S. 17 or 18 is the legal age of consent for sex and some may be as low as 16. So if you really want to know, call someone who would know...a counselor, law enforcement or a local health care clinic. No one will come after you for asking a question.....

Who knows and why care but take a look b/c it might matter?
I personally believe that it doesn't matter at what age. But be sure if your partner really cares, how do you know? Well how long have you both been going out? Also, I believe that sex could be prevented by just waiting a bit longer at least a year in a relationship.

Age of consent (age at which you can have sex at) is actually set by the state, and is also different inbetween countries.

Here's a fancy chart I found for you!
