"While the exact legal definition of a moped varies from state to state, a moped's speed generally may not exceed 30 mph (48 km/h) on level ground (in a few states this number is 20 or 25 mph (32 or 40 km/h), and in most states, the maximum engine capacity is 50 cc, although a few states allow up to 85 or 130 cc. Some states require pedals, while others do not."

Here are the laws by state:

It depends on what state you are in.

I've been using a scooter for at least 5 years as my primary mode of transportation.

If you go above 50cc, you will probably need a motorcycle license. I'm riding a 49.6cc bike, and it is sketchy to take on roads with speed limits of 45mph or more.

If you plan to ride over 30mph then you will probably need to get your scooter registered and get a license plate just like you would a car.

every state is different. Here in Wisconsin, moped must be under 50 cc's (my Yamaha Razz is 49). Under 50 regular lisence, over 50 need motorcycle lisence. Eye protection.

I'm not sure where you are located, but Dave Grohl received a DUI on a moped in Australia in 2001.
