if youre not married and youre names on the birth cert, then you likely signed a paternity declaration. if you signed a paternity declaration then the answer i m afraid is no, you cant get your name taken off. you not only signed so that the child could bear your name, but also that youre accepting legal and financial responsibility for the child until theyre eighteen years old. i saw a fellow on dateline where the mother even wetn into court and told the judge, "I lied to him, your honor. i deliberately misled him and knew the child wasnt his, that was why he signed the declaration." but the judge ruled that the child remained the mans responsibility, because the declaratrion is a legal and binding document.

No he cant change the birth certificate. It seems a bit unfair at first sight but leaving biology out of the equation, he is/was the child's father.
There's more to being part of a family than biological parentage.

sorry but you cant change it once a name is on its on there for life you cant even add anything to it the laws have all changed for the birth certs now , only thing is if your partners name isnt on the birth cirth and he thinks it is and the child is his your staking on thin ice because anybody can go get a copy of a birth cert you only need the name of the person and there date of birth . i only now that because i picked up my friends for her.

Yes, but depending on how old the child is, if you are the only father that the child knows to be daddy, they may still make you pay support for the child. Now that's screwed up.

There was recent litigation that made a non-father continue child-support payments to a child not his. He had been in a relationship with the mother.
Truly, he got screwed.

Yes. BUT... why would he want to hurt the child that way? If he brought the child up then he is the father whether he is biologocally the father or not. Why take away someones identity, and security that way?

If he wasn't married to the child's mother at the time, I would say yes.
But if he WAS married to her at the time of birth, he may be stuck

There will be very strict laws about this... try the "Births and Deaths" registrar in your region! Your town hall/local council will help you if you call.

I hope that you get it sorted! Good luck!

I would be more interested in reclaiming the child support that he may have been paying.
