My brother was recently punched in the face by a bouncer at a bar, before he had even entered the bar or had a drink there. He was being restrained by two other bouncers at the time, and it was an unprovoked fight. We are wondering if there is anything that we should/could do to address the situation, what are his rights? Thanks!

Okay more details...my brother asked the bouncer how long the wait was to get in (this place is seriously more of a restaurant than a bar) and the bouncer told him to "get the F@*% out", my brother said he wouldn't b/c he hadn't done anything, and B continued with "get the F out" with my brother continuing to say no (again, he was waiting in line, not in the place), until eventually B shoved my brother. I think my brother must have shoved him back at this point because two other doormen grabbed my brother, and he says that at that point it was over and THEN the bouncer punched my brother, with a ring on, and said "how did that taste". The police who came on the scene (no one called them, they were just downtown) gave my brother their card and said to call if he wanted to press charges. So I'm assuming that witness report, etc., was in favor of my brother.

Contact an attorney. There may be evidence one way or the other on security video. Act swiftly as these tapes are not kept for that long. You can also go directly to the police and file a complaint and it could be possibly turned over to the DAs office for investigation and consideration of charges.

When you say HE was being restrained by two other bouncers, was that your brother? Why was he being restrained? If he started anything outside the bar, I would say to cut your losses, and by the way, there is no such thing as an "unprovoked fight." Somebody had to start something. Either your brother is being untruthful to you, or you are being untruthful to us.

This raises an interesting point... while some bouncers are off-duty cops, they are not law enforcement as such, but private security... I'd contact an attorney and see if you have a case.

Take pictures of his face, and talk with an attorney. I don't think bouncers are allowed to strike people, only restrain.

Do to the fact that each state has laws that differ , better find a good lawyer and ask them . Most have the first consultation is free , you have nothing to lose....

If it was unprovoked, sure! Assault charges can be filed, attorney time! Just be sure you have the facts first.

i saw someone win a case like this on judge judy recently.
try complaining to the bar owner first.

my own opinion is to report to the police,and wateva the police says its shld be ur final answer.but tell him not to take matters in is own hands cos it might cos more trouble for him.
