I used to run a liquor store, and we were under the same instruction, to not sell to a customer that we could see was already intoxicated. The only thing you CAN do is firmly and politely inform the customer that according to state law, you can no longer sell him/her alcohol. And let that be that. Once you engage in arguing about the matter, you can talk til you're blue in the face and you are still speaking to a drunk, so don't explain yourself...just go on about your business. If the customer makes a stink, call law enforcement.

Last week, I went to TGIFs with a friend. I didn't drink, but she started drinking as soon as she got there. She ordered food but never ate it. The next time the waitress came around, my friend asked for another triple.
The waitress kindly said "I would love to give you another drink, but I am worried you don't have anything in your stomach. Can I get you some breadsticks to go with your soup. Lets wait a while and see how you feel in a few minutes."
I COULD HAVE HUGGED THAT WAITRESS!! My friend ate her soup and the breadsticks and even ate half of my chicken. When the waitress came around 20 minutes later she gave my friend a single shot.
My friend felt so loved by this waitress and tipped her well!! (She was having a bad day, deciding whether to pull the plug on her mom who just had a stroke and was brain dead)
I would gladly go to any restaurant this waitress serves even if I don't drink!! God bless her!!

In many states, it's against the law to serve alcohol to an inebriated person. That is justification enough right there.
Offer them a soft drink, coffee, anything else... but no more booze.

You softly say to the customer-" I think you need to pace yourself a little better.Let me get you a coffee and then we will see how it goes." Be firm and kind-do not embarrase them or be to loud. Become their friend.

Let your customer know, You feel he/she has had enough. Offer them a free cup of coffee, soda or juice. Be polite about it. NOT RUDE!!!!
