during this case will anyone know and how soon will they know? or will it only be after case is settled?

Unless sealed by a court, legal matters such as these are a matter of public record. In other words, yes, anybody can go down to the courthouse and research your case. In many cases, you can go online and research a case. I will include a link to an ongoing case in my county so that you can see a good example.

Exceptions would be juvenile cases, or cases specifically sealed by a court (rare.)

usually it's after the case is settled you know. innocent until proven guilty that sort of thing. should the case go ill for you then it wil be reported and usually letters are the way its done. if ouo get off the hook then nothing to worry about. but if you lose the case, assuming this is a credit matter, they will report to the bureaus or bureau and it should show up under your judgements or colections section of your credit report.
