Actually it's both.
Asking of tomato is a fruit or vegetable is like pointing to a dog and asking if it's a canine or an animal. It's BOTH.
Remember vegetable is defined as
*********
1 a : of, relating to, constituting, or growing like plants b : consisting of plants : VEGETATIONAL
2 : made from, obtained from, or containing plants or plant products
**********

It is a fruit because it has seeds. If it has seeds it is a fruit, no doubt about it, therefore tomato is a fruit.

Botanically a fruit. Politically a vegetable in the US for import and export purposes. Nutritionally a vegetable on most charts and schemes.
