the idea is my mother wants to come and live with me, they have been married for 20 years, she has a terminal diease that is why she quit claimed the deed to my name. she was able to do that because the deed was in her name only. and no i am not fond of her husband for good reason.

You need to seek legal counsel. Laws differ from state to state. How would your mother feel about that? Is it something that would hurt her? Hope you have a really good reason for wanting to do that. Not sure you would like your mother doing that to you if the tables were turned. I can't see any reason that would be justifiable other than him abusing her in some way or destroying the property.

It depends. Is your mother living there, or is she deceased? If she's alive you pose a VERY interesting question. I'm going to assume she's not living, and her husband has continued to live in her house, although it now belongs to you. In that case, you can evict him unless he has a life interest in the property or some other contractual right to stay there.
