doughnut is a recognised word and product - donut is not the same thing and therefore allows another product to appear similar but be made with different ingredients and thereby escape prosecution

doughnuts are generally obviously made from dough but donuts are more cake-like in texture

afterthought:
you will find the same is true with cream, creme, creame and so on

a different spelling allows it to be a differently manufactured product

Doughnut is the correct spelling. Donut is faster to write, and semi-literate doughnut vendors sometimes use it because they think it's more marketable.

Have a look at the spelling around here and you'll figure out why... Because Americans cannot realize that words have a root and a history, and they prefer to write what they hear, even if it is mis-spelling, simplistic or completely wrong.
