According to the Texas state law.
I'm also moving to N. Carolina in Sept. Do you know the laws there, too?

This is a great website - especially when traveling. You just need to remember that even if your state has lenient laws regarding car seats, and you go through another that has more strict laws, you need to obey the laws of the state that you are currently in.

The point of a safety seat is to help the seat belt fit your child. Rather than depending on the laws, look at your child. Is the seat belt crossing their neck when belted in without a booster seat? If so, the belt is not safe, and your child needs a booster to be actually safely secured by the seat belt.

Maryland had the strictest law around here, up to age 8 for boosters. When I learned the point of boosters, I happily followed it. And so did my kids, because they could see out the car windows. There are some wonderful boosters that go up to 100 pounds and beyond.

Have fun in N.C. It's so much nicer than Texas.
