hey i have a brother and sister who are really friggin bad and my mom wants to slap them and a police officer told us that she can slap him anywhere on his body as long as she doesnt cause bleeding or use an object or weapon as a hitting tool, does anyone know if its true or not and if its not can you clarify please? also i will choose best answer and please dont leave links to websites explaining it i dont feel like surfing the net id just do that in the first place if i wanted to, thanks bye bye.

it CAN'T be with a closed fist, it has to be open hand.
No cords or other things. it has to be the hand. there can't be
bleeding, bruises, cuts, or other marks. and hitting in the head is a thin line, so it's better, neck down.

I don't think there is an actual clear law, it just depends on a judges interpretation of child abuse. I don't have children yet, but you can be sure they will get spanked when they disobey. As long as you discipline them at home and don't leave any large bruises you should be ok, unless the kid screams bloody murder and you have jack*** neighbors that might call the cops. IMO, spanking your child on the behind is the best place if you want to discipline them, because your backside is all fat and nerve endings, so notheing can be damaged, but it's sure to hurt like hell. Also, never use your hand, so the child doesn't learn to associate your hands with punnishment, and never hit them somewhere were you could do damage, like there face, or back of the head.
So, as long as you stay away from making it look abusive, you should be ok, but try not to discipline at all in public. If you are good at disciplining them when you get home, they will think twice about acting up in public again.

The Supreme Court has said that you have a Constitutional right to raise your children in a manner you see fit including things like grandparent visitation, private education and corporal punishment. Abuse is a discretionary term in state law, and the statutes left by Sir J (who likely doesn't have any children) won't be a lot of help.

It really depends on the state... different states have different statutes. For example, here is California and Illinois:

CALIFORNIA

Law not intended to prohibit the use of reasonable methods of parental discipline, or to prescribe a particular method of parenting. Serious physical harm does not include reasonable and age-appropriate spanking to the buttocks where there is no evidence of serious physical injury. Welf. and Inst. Code Sec. 300. [Ci.] Abuse includes unlawful corporal punishment or injury. Penal Code Sec. 11165.6.[Cr.] "Unlawful corporal punishment or injury" is any person willfully inflicting upon a child any cruel or inhuman corporal punishment or injury resulting in a traumatic condition. Penal Code Sec. 11165.4.[Cr.]

ILLINOIS

An "abused child" includes any child whose parent/immediate family member/person responsible for the child's welfare/individual residing in the same house/paramour of child's parent inflicts excessive corporal punishment.
Secs. 325 5/3/ [Ci.]

Most of them don't have any wording in them about open-handed or anything like that. The only way to know for sure is to contact Child Services in your area and just ask.

I think it's good to know what the statues in your state are. I believe in positive discipline. It has greater results, and includes using consequences, not punishment. Don't get me wrong, I am pro-spanking. When it is needed, it is very effective. Yet, people who over do it can emotionally scar their children, or make them immune to spanking, aside from those who hurt their children physically.

Cops told my brother one time if he was to hit or slap the child always use an open hand, and no belts or anything, and don't leave any marks

Every state has different laws but spanking is legal in all 50 states. You cannot leave marks (bruises or welts) and in some states you have to use your hand and cannot use a spoon or paddle or glue stick or whatever, but in other states you can use a spoon or whatever.

I whoop my bad nephews all the time they come over here acting like monkeys. Now they know better over here, they just cut up with my sister because she is too much of a punk to lay into their little rears. I don't give a damn. I be damn if a little kid is gonna run me.

That's true. As long as you use an open hand, and not fist, and don't leave bruises or marks, your good. Tell your mom to go for it. If they need it, they should get it!

It depends on the state. Your mom can do this as long as she does not hit the penis or vagina. That would be sexual abuse. She may spank them lightly so long as no scars, bruises, or any other marks are left there. If you suspect abuse please talk to your mom about this.
