I wouldn't do anything to harm the cat because you could be arrested for animal cruelty....seriously. They have that kind of stuff on the Animal Planet all the time. Anyway, you should talk to the cat's owner first and see if they'll do anything. They may not know that their cat is coming in your yard or that you have a problem with it. The cat is just doing what cats do out of instinct. It's not the cat's fault so don't harm the cat. If the owner won't do anything, then call the police and tell them. I don't know if leash laws apply to cats or not, but the police could advice you further. Try to be civil first and talk to the owner.

Dogs are mostly wild they can harm people more than a cat can, dogs are dirty and filthy, a cat poops in a hole and then she's covers it up, which is very clean from an animal, dogs poop on the road.
To help you with your problem with the cat:
1) You can offer the cat some food so she stops bothering your birds, you can either put her food in your front yard, or you can put it outside your territory so she doesn't come in.
2) You can buy a dog that could scare her that way she won't bother you again.
3) Or you can be really nice to the cat that way she becomes your friend and stops bothering you and the birds.
4) You can gently ask the neighbors to keep a watch full eye on their cat.

I remember a cartoon in some mag I was reading that had two figures standing by a front door. Facing the door was a small rumpled man in hat, raincoat and rain boots and facing him was a tall man reading from a clipboard. The caption below read "Hey! This ia petition to allow dogs to roam free and dump where they please!". And only after reading the caption did I realize that the rumpled man was a dog.
As to the cat, hook a sprinkler with a servo mech. up to a motion sensor. That ought to take care of Tabby with no harm done.

Cats are allowed to roam free for two reasons, mice population control and because they are not hardly the threat like a dog can be.
A lot of stray cats survive out of garbage cans but can have pretty "good" days getting meaty meals off of mice (and unfortunately birds)
I'm not sure if your nests are up trees or maybe on a part of your house. I hear cats hate pepper. Maybe you can make a pepper medley of pepper, water, and maybe something gooey (honey maybe) and apply it around the tree, maybe the smell will be enough to repel them

cats are not harmless. my family had a lot of trouble with our neighbors cats getting into our garage and tearing things up, along with fighting with the squirrels that had a nest and the birds and scratching at our siding. it is basically a double standard that is out there. i would try taking to the owner of the cat or possible the Audubon society as they are really good about helping if birds are involved.

turn the hose on the cat. This will not hurt the cat but will deter it from coming into your yard. Hurt the cat and be warned the police can come after you and it puts you up there on the worst persons going list

talk to your neighbor about keeping his cat inside. look and see if your town has a leash law. that does apply for cats as well, if it does you can tell him that he either keeps his cat on a leash or you will call the cops or animal control on him. you can try and suggest that his cat wear a bell on it's collar so the birds will hear the bell and be scared off so as not to get pounced or worse.
no cat should be alowed outside unattended.

if you have read recent news story about a medication being raised 5000% read carefully and you will discover that it is for treating people infected with the cat parasite toxoplasma Gondi - the Center for Disease Control states that this parasite is the number one cause of death from food borne illnesses - also take time to read study by the Audubon Society that shows that BILLIONS of birds are killed by cats - one poster spoke admirably about how cats bury their feces - I have both vegetable and flower gardens and am continually walking on - kneeling in and getting cat feces on my hands while I am weeding - the other day a cat came into my house while my front door was open and I was outside tending to my gardens - I came home to a pile of cat feces on my pillow on my bed - I found the cat under my bed and I shooed it out with a broom - it ran into by utility room and urinated on my floor - then into my kitchen and onto the counters and broke several of my decorative plates - then into the living room knocking over pictures and lamps - they are not harmless for several reasons - and can be deadly so get a clue cat owners - and take your rightful responsibility for keeping them away from your neighbors property.

To answer the headline... Dogs are more capable to harm people, espically small children than cats...
Secondly, ask your neighbors to handle the situation politely.
if that does not work then call animal control... if they dont listen call your local DNR rep.

cats are aloud to run free because thay do not bite any one unless thay bother the cat thay are also not as noisey as a dog. their really is not a solution to your problem other then the owner of the cat keep it in doors it is in the cats blood to stock and pray on birds and small creatures i am a cat lover and i keep mine in doors he likes to watch birds and i am sure he would love a chance to catch one if he could get the chance
