If you are not here legally then your child born here should be of the same citizenship as the mother that's the way it's done in Sweden. I have a cousin on my wife's side who lives in France and she wanted to come here to visit when she was about 8 mos pregnant and she was turned away when she applied for her tourist visa. They did thee right thing because I know she wanted to have her baby here so it could be a US citizen. Anchor babies are a serious problem in America and we need to change the law even though it would take a constitutional amendment. When the 14th amendment was written 1868 it was in response to slavery and not as a tool to allow illegal immigrants an open avenue to citizenship after they broke the law of the land to get here.

A group of attorneys and immigration experts are trying to do something about the problem RIGHT NOW.
Craig Nelsen, director of Friends of Immigration Law Enforcement Stated :
"The situation we have today is absurd,There is a huge and growing industry in Asia that arranges tourist visas for pregnant women so they can fly to the United States and give birth to an American. This was not the intent of the Fourteenth Amendment; it makes a mockery of citizenship."

The key to undoing the current misinterpretation of the Fourteenth Amendment is this odd phrase
"AND SUBJECT TO THE JURISDICTION THEREOF."
The whole problem is caused by the fact that the meaning of this phrase, which was clear to anyone versed in legal language in 1868, has slipped with changes in usage. Fortunately, there is a large group of court precedents that make clear what the phrase actually means:
The Fourteenth Amendment EXCLUDES the children of aliens. (The Slaughterhouse Cases (83 U.S. 36 (1873))
The Fourteenth Amendment draws a distinction between the children of aliens and children of citizens. (Minor v. Happersett (88 U.S. 162 (1874))
The phrase "subject to the jurisdiction" REQUIRES "Direct And Immediate ALLEGIENCE" to the United States, NOT just physical presence.
(Elk v. Wilkins 112 U.S. 94 (1884))
There is NO automatic birthright citizenship in a particular case. (Wong Kim Ark Case, 169 U.S. 649 (1898))
The Supreme Court has NEVER confirmed birthright citizenship for the children of illegal aliens, temporary workers, and tourists.
(Plyler v. Doe, 457 U.S. 202, 211 n.10 (1982))

What a funny question. Let me tell you that in most countries according to the law a newborn has the right to have the country´s citizenship, not only in the US, and that is because citizenship is acquired by birth simply as that. Also the US is an inmigrant nation, ther real americans of the US are the american indians, all the rest came from elswhere.

To Dona concerning her comments, I didn't come from somewhere else. I was born in the USA from American parents. I'm a "real" American. As a matter of fact, anyone born in the USA is a native American. So enough with this "only indians are real Americans" baloney.

The "anchor baby" loophole is outdated for this day and age and needs to be removed from the books. This is just another enticement to encourage illegal immigration.

This is rediculouse. The us sint built on one race of ppl. If u deport all the "anchor babires" then ur gonna have to deport evry single person in the US. Since i recall most people are of european ancestry.

haha... that's the strategy of all illegal immigrants - to have babies born here in the US so that they'll have a good excuse of not being deported back to their country.
let's just hope that none of them babies will become a US president in the future...
