Im 16 yrs old and have a 5 month old and have know clue what rights i have over my baby. Im not married and still with the father but living with my parents. The father is the same age as me and his parents are trying to get Custody over my child. The father lives with his parents. I want to know what right i have know and what rights i will have if i get custody.

This is something I'd talk to an attorney about. I'm curious as to why the boy's parents feel they have a right to this child.

i was also a teen parent at ages 15 and 17. i am still with the father of both my children (21 now) but when i had my babies, the father's parents tried the same thing. (i was living with my parents and he his) first they wanted a paternity test then they wanted custody so on and so on. the first thing that i did was consult an attorney that does custodial cases. these laws and rights differ by state, so check with a local custody attorney and a domestic relations for child support from the father or the fathers parents. the most important thing that i can tell you from my experience as a teen parent it to stay in school, your life and your babies life will be much more better!!!

I am not certain about this, but as a minor, you and your child are protected by the law, and your "baby's daddy" will only have legal recourse after you turn 18 or are declared an emancipated minor. As you are still a minor, and probably listed as a dependent of you parents, you and your child both fall under that aegis.

BTW, if you are serious about maintaining your parental rights, file a statutory rape charge against him. As you were under the age of consent, and you have biological proof, the case should be a slam dunk. It makes him a felon, registers him as a sex offender, and most courts have laws in place to prevent sex offenders from taking custody of any children they have fathered as a result of their crimes.

Honestly, you need to sever this tie. Cut this guy loose, make sure your rights are protected, and make sure that the courts defend you. While I'm not sure how child support works with minors, make sure that you get what you deserve from this situation.

And whatever you think it will do for you, do not consider getting married to this person, as it will completely defeat any chance you have of putting up a fight for custody if all other factors are in his favor.

They can not take your child away unless they prove you as a unfit mother. Just because they want the baby means nothing. The father is in the same position you are he is not any better off than you are. First of all you allready have custody if this child has lived with you since it was born you have custody. Dont worry they are just trying to scare you because you are so young.

If you successfully defend your custody, you have the right to collect child support. Unless you're a horrible mother, you'll keep custody. Courts don't like to take a child away from its mother unless the child is clearly being abused or neglected. It sounds like your baby's father's parents are just jerks. I would try to talk with someone, a lawyer or child advocate person, to get some input as far as where you live as each state varies. And to those who said that you screwed up you life, etc. etc. I say get ****! I very much admire your determination to care for your child even at such a young age. What kind of involvement do you have with your parents as far as this is concerned b/c that may be a factor in it also. Good luck

While the father has the same right to the child that you do I don't think his parents have a right to the child unless you are incompetent.

I'm not sure of your legal rights, but I know if you are in for a custody fight the first thing you need is a good lawyer. Good luck to you!

Too bad you had to get pregnant before you were old enough to be the best at mothering. Perhaps this is what they think too. I doubt that you have told the whole story here......

Please use birth control from now on. Babies need adult parents.
