Can sum1 be referred to a Muslim if they don't pray 5 times a day?Answers referring to the hadith and Qur'an plz Jazakallah Khairun in advance

There is no straight answer for your question brother. It depends on a few things. for example what kind of Muslim is this person?

1) A Muslim who doesn't pray cos s/he is lazy, lacks will power, or think they'll make up the prayers when they get old etc, but know in their mind that they are not fulfilling an obligatory duty upon them and that they could be punished in the Hereafter.

2) A Muslim who doesn't pray cos of all kind of reasons but in their mind they don't think they are doing 2much wrong, they think it isn't really necessary or that they will be automatically forgiven in Hereafter.

The first example is a sinner but still a Muslim while the second can't really be referred to as a Muslim cos s/he is in fact denying a fundamental part of Islam. That's why there is a belief in Islam that we humans are not really in a position to judge who is a Muslim and who isn't. The Qur'an says: "O ye who believe! When ye go abroad in the cause of Allah, investigate carefully, and say not to any one who offers you a salutation: "Thou art none of a believer!" Coveting the perishable goods of this life: with Allah are profits and spoils abundant. Even thus were ye yourselves before, till Allah conferred on you His favours: Therefore carefully investigate. For Allah is well aware of all that ye do." (4:94).

Also It is in Hadith that once during a military expedition a man, when he saw the Muslims, said: “Assalamu Alaikum, there is no god but Allah, and Muhammad is the Messenger of Allah.” But a Muslim killed him, thinking that the man had proclaimed the Kalima just to save his own life. When the Holy Prophet heard of this, he was very angry, and he reprimanded that to the Muslim. But he replied:

“O Messenger of Allah, that man read the Kalima merely to protect himself from our sword.”

The Holy Prophet said:

“Did you open his heart and look inside it?”

Prophet (peace and blessings of Allaah be upon him): “Between a man and shirk and kufr there stands his neglect of the prayer.” (Narrated by Muslim in Kitaab al-Eemaan from Jaabir ibn ‘Abd-Allaah from the Prophet (peace and blessings of Allaah be upon him)).

salat is what separates a believer from a non-believer.

now that doesnt mean you go around calling muslims who dont pray non-believers (especially with no concrete evidence). instead, you should encourage them or tell them to start it one at a time.

You are a Muslim as long as you Believe in God and Hazart Muhammad PBUH.
Yeah you can be not a good follower but that does not change your religion. to be a good Muslim you have to believe on Kalma.

Yes, it doesn't change your religion because you don't pray 5 times a day.. and don't feel bad my pakistani muslim man don't pray either

You are a muslim if you said Al-Shahadah. if you dont pray then you are aassy. You will be punished for not praying but if you repent and start praying regularly then insha-Allah you would be forgived

People claim to be Catholic and never go to church or confession. People claim to be Christian, but never accept Jesus. People claim to be Muslim, but never genuinely pray. People claim to be Pagan, but still harm others (pagan creed: Harm none). People claim to be Bhuddist, but do not seek enlightenment. People claim to be athiest, but still yell at God (why yell at someone you don't believe in??). I think that about says it all.
