Many of you believe that laws haven't changed since the 1800s.
1) there is no such thing as "anchor baby" in the law anymore
2)you can't come with an immigrant visa unless you win the Green Card lottery-there is no other LEGAL way(apart form political asylum, but very few countries qualify)
3)if you come on a work visa you get a valid SSN for the rest of your life and you keep on paying taxes no matter if your visa has expired or still valid
4)if your visa expires, you cannot obtain a legal status , no matter if you continue paying all taxes or not-you are simply not given a chance!
Maybe these facts will give a clearer idea of today's laws and you stop asking silly questions like:
-why don't you do it the legal way
-how do illegals pay taxes
-anchor babies(that's the most laughable of all, since there hasn't been such a thing since the 1800s..., otherwise we'd all have a baby right away and get citizenship!)
-calling all illegals Mexicans...

To open_borders: maybe your friend married for papers, otherwise there is NO way to get a resident status after your visa expires(an most visas BTW are non-renewable). I have talked to many lawyers, too, but the law simply doens't allow it. Or maybe your friend did it years ago, when the laws were immigrant-frienly.

to DAR: I understand your concern, but it's the US govmt who can make every illegal pay taxes by letting them stay in US if they have a job already. Now they are just encouraging identity theft and fraud, since illegals come to work and they are ready to do anything.

to Sashie: yes, the babies are US born, but that doesn't help in a nyway their parents' legalization. Only after the child is 18, they can plead for their parents.

to JD: Having a baby here doesn't make ANYONE a citizen! I have friends with babies, none of them is legal and their lawyers advise them to wait for amnesty. My friends have university degrees , but their ilegal status prevents them from finding good jobs. They haven't been deported, but if they were to leave the US, they'd never be admitted back although they have babies here.
Read the law, before speaking.

If you tell me there is no such thing as pregnant women coming to the border to be picked up be an ambulance and taken for delivery to a US hospital with the right not to stop for customs and inspection

How do illegals pay taxes? SO WHAT SO DO I AND I'M NOT ABOVE THE LAW.

56% of illegals are Mexicans and they are the ones fighting for rights and privieldges that are not theirs to have and we'll be damned to let them have those!!!

I didn't see any other foreign nationals protest besides Mexican flags to demand more crime and lawlessness and shove it down our throats, did you?

I think you are confused about what an anchor baby is. The baby gets benefits like food stamps, the hospital delivery is paid for by tax payers, and eventually when the child is old enough the child (under current law) can petition to bring its parents in.

It used to be worse, but this is plenty bad enough.

We subsidize education and services for poor people even if they pay all taxes. Not paying taxes, as many illegals don't, is salt in the wound. However, that doesn't erase the fact that the reason there need to be and are legal limits on immigration of poor people is because they drain services we pay for for our own people. There are so MANY illegals now that those services don't adequately support our own people.

People from foreign countries have no right to come here and get the services we pay for. If they can't come under our quotas, they shouldn't be here.

My point is that even if poor people pay taxes, we cover their cost of education and health services. It is conscious wealth redistribution to a limited but significant extent. Otherwise we would let more poor come legally. They are a net drain on resources.

According to estimates, some 200,000 so-called anchor babies are born in the United States every year.
Once a mother has birthed a child on American soil, she can then seek to obtain citizenship for herself on the strength of the family-reunification laws.
Even before this happens, she is very hard to deport, as the mother of an American, and the full panoply of welfare benefits is available to her, as is affirmative action if she is a member of a racial minority.

A group of attorneys and immigration experts are trying to do something about the problem RIGHT NOW.

Craig Nelsen, director of Friends of Immigration Law Enforcement Stated :
"The situation we have today is absurd,There is a huge and growing industry in Asia that arranges tourist visas for pregnant women so they can fly to the United States and give birth to an American. This was not the intent of the Fourteenth Amendment; it makes a mockery of citizenship."
(Sound Familiar??)

The key to undoing the current misinterpretation of the Fourteenth Amendment is this odd phrase

"AND SUBJECT TO THE JURISDICTION THEREOF."

The whole problem is caused by the fact that the meaning of this phrase, which was clear to anyone versed in legal language in 1868, has slipped with changes in usage. Fortunately, there is a large group of court precedents that make clear what the phrase actually means:

The Fourteenth Amendment EXCLUDES the children of aliens. (The Slaughterhouse Cases (83 U.S. 36 (1873))

The Fourteenth Amendment draws a distinction between the children of aliens and children of citizens. (Minor v. Happersett (88 U.S. 162 (1874))

The phrase "subject to the jurisdiction" REQUIRES "Direct And Immediate ALLEGIENCE" to the United States, NOT just physical presence.
(Elk v. Wilkins 112 U.S. 94 (1884))

There is NO automatic birthright citizenship in a particular case. (Wong Kim Ark Case, 169 U.S. 649 (1898))

The Supreme Court has NEVER confirmed birthright citizenship for the children of illegal aliens, temporary workers, and tourists.
(Plyler v. Doe, 457 U.S. 202, 211 n.10 (1982))

If they aren't given a chance to obtain legal status, it's because the government is trying to limit the incoming immigration and control costs spent on illegals. If they don't have legal status, they need to get out.

If an illegal has overstayed their visa and is still paying taxes,
a. they're idiots, and
b. they need to get out

The point about not all illegals being Mexican is true. There's bound to be 1 or 2 of those 12 million that came from Cuba.

GET OUT ILLEGALS.

This illegal issue is really difficult!

I posed the question of how do we enforce our laws to root these people out without infringing on the rights of citizens.

It is nearly impossible to do. There will be challenges to any legislation passed from civil liberties groups.

The SS# was not intended to be a valid form of ID. A national ID system on driver licenses would help, but it wouldn't cure the issue. The constitutionality of it is a big ? too.

Many changes in our laws and systems are needed. I thought about how to get into the US and get ORIGINAL birth records. I figured out ways to do it in about 5 minutes.

Getting high-quality forged documents is about as hard as scoring some pot, maybe not that difficult.

If someone is working on forged docs, they pay taxes. It can shaft someone badly on IRS and SS issues though.

Were I an illegal, I'd score original birth docs and get a legit SS#. If you have no finger prints on file, how can anyone catch you?

Chew on that.

I agree there is a whole lot wrong with your statements
I worked my butt off to get here--no pop no cigarettes-nothing. I did it the right way. And I saved with a passion. And I didn't make a fortune barely enough to live on. It took a lot of hard work.
And My taxes are high enough now.
If you don't see a problem you haven't looked
Why did I do all that -so someone else can get it for free or easy?

Whoa there kitty cat. Your second point is stupid. Just because something is hard to do the legal way does not make it OK to break the law. It is hard for me to go to work everyday and make a living, even harder for other people; that does not give me, or anyone else the right to break the law to do so. Get over it.

There is a flip side to those myths as well:

-They do jobs Americans won't.
-The economy will crash.
-We will pay outrageous prices for ag goods.
-We are ALL immigrants

Hmmm .... methinks you are confused ... babies born on American soil to anybody of any nationality actually do get American citizenship ... the BABY does, not the parent ... consequently they are still called anchor babies .... as for becoming a permanent legal resident, grant you overstaying your visa rights isn't one of them ... but there are still plenty of avenues open, including of course marrying an American ... I would suggest you really check with the immigration authorities before you make sweeping statements ....

In Oklahoma, social workers are knowingly allowing illegal immigrants to sign up for welfare by putting in someone else’s Social Security number for them! In other words, if you live in Oklahoma, you might be receiving welfare and not even know because some illegal is receiving benefits under your name. Isn’t that nice?

and i have talked to some illegals i know and they are upset by all this and one even said he didn't want to be legal as he would have to pay taxes . they have fake ss cards and fake car insurance , no drivers license
