Were you being a moron? Did you cross the line or insult him/her? Let it go if you were getting out of hand. I've had one to many a couple of times and am sure I have acted like a complete jerk.
Was he/she just being rude? Tell the manager why the Moron serving your table isn't getting a tip and also why you are going to slam them for service on a Citysearch review and every other site you can find (assuming your city is covered). Give a very complete and balanced review on Citysearch and include the insult, tell people you wouldn't eat there ever again. If you put a little time in to it people will find it helpful and your review will bounce to the top. Hopefully you'll dissuade others from eating there too...now who's the moron???

Tell another staff member that you wish to speak to the manager. In a polite way express your dissatisfaction with your current waiter (citing the inappropriateness of the waiters behavior) then ask to be served by another waiter. Do this diplomatically so as to not lend credence to the waiters remarks. Then make that your last dining experience at this establishment.

WHAT???? Are you serious?? I would have grabbed my food and dumped it on his head! I did that once, a cocktail server called me a hoe so I grabbed my beer and dumped it on his head. Same concept applies here. And I would demand that waiter was fired. But the real question here is why did the waiter call you a moron? If you said something totally inappropriate then maybe you deserved it. But if you did nothing wrong..... Well paybacks are fun

Quietly ask to see his manager, express your dissatisfaction of how you were treated, make it clear that by this insult you have no intention of paying for the meal and leave without making a scene.
By getting irate and making a fuss, it lends credibility to the waiter from the managerial perspective, though it is not an excuse.
By maintaining your composure you will more likely get the restitution that you are seeking.

Well first of all, were you acting like a moron? I suppose that's subjective and the point is rather moot isn't it. Regardless of whether it was deserved or not, you should address the problem with the manager. Whether you leave a tip is up to you.

well that depend on where you are at in the meal... if it is before you get your food and after you have ordered. then I would complain to the manager and then wait for him to bring all the food out them i would leave and with out a tip of coarse
