I am a 3 years experienced .net software engineer, from Bangladesh, having excellent backgrond in career and academic path (BSc in Computer Science, with 3.62 CGPA). What should I EXACTLY do to get H1B visa to be employed in USA? In addition I am a Muslim, I know it's hard to get visa for muslims in USA :(

Firstly, you need to have a job offer from a US company (petitioner). The petitioner will file an H-1B visa application your behalf (the beneficiary). If the application is approved, the approval notice will be forwarded to the US embassy in Dhaka (Bangladesh) and you will be notified to come in for an interview. If the position is legitimate, and you provide all the document required, your visa should be approved, but as I tell people all the time, embassy staff CAN deny a visa application even if USCIS approved the initial petition.

The next H-1B 2008 fiscal year application begin April 1, 2007 since the cap has been reached for 2006. So you're out of luck at this point but it's possible to apply next year if you have a degree (or equivalent work experience) and a job offer from the US

People who seek to enter United States using the H1B visa must be offered a job in the United States and must be sponsored by the employer of that company/organization. Also it is the duty of the US sponsor or the employer to prove that the position requires a skilled person from a specialty occupation and the intended employee has the required skills. The Specialty Occupations require a high degree of specialized knowledge (usually this requirement can be met by having a 3 year degree or 3 years’ equivalent post-graduate experience), such as mathematics, architecture, engineering, and other occupations.

You cannot apply for an H1B visa, a petition must be submitted by a legitimate US company on your behalf.

Please note: Visa issuance is not based on religion - it is not even a question on the visa application; being Muslim or not being Muslim is not a selection criteria.
