My husband works close to our childs nursery and is considered to be the primary carer in an emergency because I work out of town. One morning he notified his employers that he would be unable to go to work because our child was unwell they replied that they could not get anyone to cover part of his job and that they considered the wife to be the primary carer and that he ought to try and get to work. Is this reply correct?

No they are not correct. They are being old fashioned and sexist.
Im assuming you are in the UK, there are regulations regarding parental leave, if your child is under 5 a parent (mother or father) is entitled to time of work (unpaid) of up to 13 weeks per child.
There may be conditions like he has had to have worked in his job for 1 year.

RE: THe comment above, since when have you needed a Court order to say who is the primary carer?????

It is a general believe that women carers are better off than men.However it is not always the case as men too can be good carers. The answer is not perfectly correct .In any case in the event of a child getting sick anyone between the two parents can care for the child.

It sounds like they are being sexist. You need a good lawyer if you want to fight them. Parenting is 50/50 nowadays, if his employer doesn't like it, get a lawyer and slap 'em with discrimination.

If he has a copy of the court order, and provided it to his employers, then his company doesn't have the right to say that. If he hasn't provided them with that court order, then he doesn't have a foot to stand on.

It takes a court to decide if something is sexual discrimination, but it sounds to me like it is. He may want to check into the companies sexual discrimination policy.
