It's a criminal activity one step below a felony. Basically something that you stand a good chance of getting the maximum penalty for a misdemeanor.

If you don't recall getting arrested and jailed anytime recently, I doubt you have one.

If you HAVE however,

A lot will depend upon the state. Some states have classes of felonies and misdemeanors.

What the application means is have you ever been convicted of something as a misdemeanor that COULD have been charged as a felony (that is a serious misdemeanor).

For instance, in CA, theft with a prior theft can either be prosecuted as a felony or a misdemeanor, the discretion is left up to the prosecuting agency.

Remember too that it is for convictions, not arrests. If you have a more specific situation you'd like to know about, email me.

There are three classes of misdemeanors, ranging from the most serious (Class 1) such as DUI to the least serious (Class 3) such as harassment. There are also lesser offenses such as petty offenses and traffic infractions.

Other serious misdemeanors include any crime involving sexual assault because a conviction for this crime requires psychosexual evaluations, treatment, and sexual offender probation.
