I called customer service but they came up with some bullshit excuse that I didn't make the payment on time.

First of all, I made a payment on 6/05 to cover the bill due at the 10th. Then made another payment on 6/14 to cover the bill for the upcoming bill since I was going on vacation to Mexico...now that I'm back I see this late payment...what should I do what are my rights?

if you have proof--ie canceled checks take them to your branch and make them make the correction for you. Tell them it is part of the fair credit reporting act. If they have reported it to the 3 credit reporting agencies then they must make the correction but you must dispute it with them. If they fail to make the correction remind them that if you are denied credit based on their false reporting that you can sue them for up to 3 times the amount of credit lost + punitive damages. They will correct the error I promise you!

Having dealt with BOA on many occasions I understand things get mixed up often. I suggest you gather your evidence and call again in 8 hours. You will get a different customer service rep. call each day until it is resolved. The service representatives have the power to simply remove late charges and resolve customer problems if they see fit. I suggest the kind nice approach more often then the mean spirited one. I know its hard to be nice and play stupid but it often works.
