We should first all agree that just because they are labeled Terrorist does not mean they are. Then as stated before give them a fair trial, but using international law, Like Geneva convention, even though we never signed it. If found innocent they should be given an apology sorry for the mix up, and trip home. The ones found guilty should be put on airplanes and taken to the mountains where it is believed bin laden is, beheaded, their head thrown out of the plane, then the Americans on board can evacuate and let the planes fly into separate areas they believe Bin Laden to be in or little villages that are believed to be supporting the Taliban. Even special made remote planes would work for this if there is a way to remove the head and spread it across the country.

I think, first of all they must be confirmed as terrorists. Second I think they should be tried in the country in which either they were captured or came from. Many countries that terrorists come from have very harsh penalties. i.e. stoning to death, beheading, etc.. If they are tried and convicted in the US they will just get 3 meals a day in a nicer living condition than they are used too. Also if they get the death penalty all they will do is go to sleep from a shot. I would like to see them suffer.

We are getting to the point where it makes more sense not to capture them at all.

Now people want 'public trials' - in cases that involve classified information. So we now have choice - let the terrorists go or be forced to reveal classified information to the enemy.

I wonder just how many of our soldiers will die because of these policies?

Torture them for any information we can get regarding the terrorists we haven't caught yet, then cut their heads off and drop them in Mecca. They use terror tactics to get to us, so I think we should give as good as we get. I'm tired of the U.S. always taking that first punch to the nose, and then months later, getting around to retaliating.

And in response to Kris_C's answer: The terrorists are not part of our Military, so they can't be tried under the UCMJ.
Uniform Code of Military Justice is for active duty or reserve service members only.

well, in islamic countries torture and beheading seems to be the thing to do to our guys, so why not give them to me one at a time, let me select a good sharp sword from my collection and let me relieve them of their heads.... God knows they don't use them anyway or they wouldn't be terrorists or at a minimum wouldn't be caught, and as an afterthought, let's televise my playtime to the world. We'll make a new network.... got to die tv. the all beheadings network.....

Or we could tie them up in a sack with a dog, a snake and a monkey and toss them in a river for a bit of creativity.
